1. Obligations of the bathing facility
1.1 Granting use of the facilities, assumption of risk by guests
1.1.1 The bathing establishment allows guests to use the facilities of the bathing establishment at their own risk within the framework of the provisions of these bathing regulations. (JUMPING IS PROHIBITED!)
1.1.2 It is not possible for either the bathing complex or the staff to prevent bathing accidents in general. In particular, guests themselves bear the risks associated with practising sports on the bathing area.
1.1.3 The same applies to injuries and other interference with the personal
personal sphere by other guests or other third parties who are not members of the bathing facility staff.
1.1.4 The bathing establishment only assumes the following obligations towards the guests.
1.2 Opening hours and granting of access
1.2.1 The bathing establishment is obliged to allow access during the opening hours announced on the notice board or by the supervisory staff.
1.2.2 If the officially authorised number of visitors is exceeded, the bathing facility may, with the help of the responsible staff, prohibit the admission of further visitors. In such cases, visitors must expect waiting times.
1.2.3 The bathing complex reserves the right to refuse entry to persons whose admission to the baths appears questionable without giving reasons. (Alcohol or drugs)
1.3 Condition and operation of the facilities
1.3.1 The bathing establishment is responsible for ensuring that the facilities are installed, operated and maintained in accordance with regulations. In particular, the bathing facility must comply with all applicable hygiene and safety regulations. The bathing establishment has no further obligations.
1.3.2 As soon as the bathing establishment becomes aware of a malfunction, defect or
or defectiveness of a facility that no longer guarantees safe operation, the bathing establishment shall immediately prohibit the use of the faulty facility or restrict its use in an appropriate manner.
1.3.3 The bather is responsible for complying with the instructions of the responsible staff.
1.4 Monitoring compliance with the bathing regulations
1.4.1 The bathing establishment shall monitor compliance with the bathing regulations by guests and other persons present on the premises of the bathing establishment within reasonable limits with the help of its responsible staff. If disorderly behaviour is detected, the persons concerned will be warned and may be expelled from the premises if necessary.
1.5 Assistance in the event of accidents
1.5.1 In the event of an accident, the bathing establishment shall immediately initiate assistance measures with the help of its responsible staff within reasonable limits.
1.6 Assistance in the defence against reported dangers
1.6.1 If an imminent danger to the health and life of guests is made credible to the bathing establishment, in particular to the responsible staff, by guests, the bathing establishment shall endeavour to avert this danger with the help of its staff within reasonable limits.
1.7 No possibility of supervising minors, underage persons, disabled persons and non-swimmers
1.7.1 The bathing establishment and its staff are not able and therefore not obliged to supervise minors, persons under the age of majority or physically or mentally disabled persons and non-swimmers

1.8 Liability of the bathing facility
1.8.1 The bathing establishment shall only be liable for damage caused to the guest by it or its staff through unlawful behaviour, in particular behaviour in breach of contract and culpable behaviour.
1.8.2 The bathing establishment is not liable for damage caused by disregarding the bathing regulations, any other regulations governing use or by disregarding the instructions of the staff, by any other fault of the injured party or by unavoidable events or force majeure, in particular also by interference by third parties. Contributory negligence shall lead to a corresponding apportionment of damages. The same shall apply mutatis mutandis to any special rules of use (e.g. for saunas etc.) displayed at the respective equipment and facilities as well as to any prohibitions or restrictions on use within the meaning of point 1.3.para.2.
1.8.3 The use of car parks is at the user’s own risk. The bathing complex is not obliged to guard car parks or to maintain their areas and other facilities in order to protect vehicles from damage (e.g. from nails, broken glass or potholes).
2. Obligations of the guests
2.1 Supervision of children, minors, non-swimmers and disabled persons
2.1.1 The persons otherwise responsible for the supervision of children, minors, non-swimmers and disabled persons (e.g. the legal guardians, relatives or corresponding supervisors or carers) must make appropriate provisions for the supervision of these persons. Minors up to the age of 8 must be accompanied by a responsible person.
2.1.2 These persons subject to supervision shall remain responsible for supervision even if they do not enter the premises of the bathing facility or leave prematurely.
2.1.3 The applicable youth protection regulations, in particular bans on alcohol and smoking, bans on staying, obligations of legal guardians, must be observed by the young people and their legal guardians.
2.2 Instructions from the pool facility staff
2.2.1 Guests are obliged to follow the instructions of the responsible bathing facility staff without restriction. This also applies if a guest is of the opinion that the instruction given to them is unjustified.
2.2.2 Anyone who violates the bathing regulations or bans on the use of certain facilities (e.g. sauna) or restrictions within the meaning of point 1.3.para. 2 or who disobeys the instructions of the responsible staff may be expelled from the baths by the staff or another representative of the bathing facility without any right to a refund.
2.2.3 In special cases, a ban on future visits may also be imposed.
2.3 Hygiene regulations
2.3.1 Guests are obliged to maintain the utmost cleanliness throughout the bathing complex.
2.3.2 The barefoot area may not be entered with street shoes.
2.3.3 The bathing complex may not be visited with infectious diseases.
2.3.4 For reasons of hygiene, a shower must be taken before entering the pool. The showers must be turned off immediately after use.
2.3.5 The use of soap, shampoos or detergents and the washing of swimwear in swimming and bathing pools is prohibited.
2.3.6 Waste (bottles, glasses, cans, paper, etc.) must be placed in the waste bins provided.

2.4 Refraining from endangering or causing a nuisance
2.4.1 Every guest is obliged to show consideration for other bathers, especially with regard to noise. Therefore, everything that annoys or even endangers other bathers must be avoided.

2.5 Use of pools, equipment, etc.

2.7 Bringing in and loss of items
2.7.1 Please leave valuables in your room; no liability is accepted for valuables brought into the pool area.
2.7.2 Any items found must be handed in at the hotel reception.
2.8 Duty to report / duty to provide assistance
2.8.1 Accidents, thefts and complaints must be reported immediately to the responsible staff at reception or the hotel management.
2.8.2 Every guest is obliged to provide the necessary first aid or other assistance.
2.9 Consumption of food, alcohol and beverages
2.9.1 Food and beverages may only be consumed in the designated areas.
2.9.2 The use of glassware is prohibited in the barefoot area.
2.10. Miscellaneous
2.10.1 Any kind of commercial activity or advertising in the area of the bathing facility requires the consent of the owner.
2.10.2 Smoking is only permitted outdoors.
2.10.3 Taking photographs of other bathers without their consent is prohibited.
